Understanding Damage Caps in Medical Negligence Lawsuits
 20 Oct 2010, 7:29 pm
If you are planning on filing a medical negligence lawsuit against a physician in Belgrade, Montana, it is essential to understand damage caps. In legal jargon, a ‘damage cap’ is a tort reform that aims at limiting the amount of compensation that can be charged from a physician in a medical negligence lawsuit. There are 27 US states, including Montana, that recognize damage cap under tort and personal injury laws.

Damage Cap: How can it Affect Your Lawsuit

According to the law, it is believed that a jury is the best authority to decide on the compensation in a particular lawsuit filed in Belgrade, Montana. The jury evaluates economic and non-economic damages (physical and mental pain) suffered by the victim due to the negligence of the defendant. Based on the evaluation, the defendant is ordered to pay compensation. However, this standard procedure of deciding compensation has a slight deviation in lawsuits filed for medical malpractices. In such cases, the jury cannot order compensation in excess of the damage cap prescribed by the state laws. This anomaly results in poor compensation to the victim even if medical negligence has resulted in gross damages.

Medical Malpractice Lawsuits in Belgrade, Montana

Here are some key points related to medical malpractice lawsuits in Montana:

  • A medical negligence lawsuit can be filed in case of personal injury or wrongful death

  • Montana’s tort law requires the victim or victim’s family members to file the case within three years from the date of injury or death.

  • Under comparative negligence clause, a lawsuit can be filed against non-parties, such as the company manufacturing the drug that is responsible for wrongful death.

Medical malpractice cases are complex and require substantial evidences to file a case against physicians. Consult an expert personal injury lawyer in Belgrade, Montana, to understand the procedure to report medical negligence.

Billings, MT - Expect More "Deny, Delay, Defend" Tactics As Insurance Company Profits Decrease
 2 Aug 2010, 11:37 pm

The nation's property-and-casualty insurance companies have suffered a combined 53% decline in profits during the first half of 2008. Insurers' earnings dropped to $16 billion the first six months of the ear from $35 billion in the same period last year.
